Acceptance Of Terms.
Welcome to the Online Sunday School™ web site, a shared
ministry of Simply Christian®. At the current time we are a mostly l volunteer
ministry effort.
The Online
Sunday School™ (OSS), is a
suite of christian educational interactive puzzles, games, quizzes
and activities mostly related to
The Revised Common
Lectionary.
The OSS is designed to help augment a church's Sunday
school program by providing online interactive activities related to the
weekly bible lessons of churches following the Revised Common Lectionary.
This
site is made available to churches and families and therefore those attending the
church via either the church's web site, the church's United
Methodist Conference website, or by directly accessing the OSS's web
address (URL). By
accessing or using any part of the OSS website, you agree to be bound
by all of the terms and conditions of this agreement.
If you do not agree with these Terms and Conditions, please
do not use this Website.
2.
Your Rights.
Simply Christian® grants you a non-exclusive, non-transferable, limited
right to access, use and display this Website (the "Site")
and the materials provided hereon, provided that you comply fully with
this Agreement. The contents of the Site are only for your personal,
noncommercial use. You agree not to interrupt, or attempt to
interrupt, the operation of the Site in any way. As a user of the OSS
web site you do not have the right to copy or distribute the graphics,
audio, or video clips of the website. Many people have worked hard
to provide this web site.

Copyright and Trademarks.
Copyrights-The OSS website
has been registered with the U.S. Copyright Office and is the property
of Ferrans Enterprises, LLC. Simply
Christian has a license and permission to operate, enhance, and provide
content for the website.
Trademarks
- Simply Christian® is a registered trademark of Ferrans Enterprises,
LLC in the United States. The Online Sunday School™ is
a trademark of Simply Christian and in the process of being registered. All
other trademarks, servce marks, and logos used in this web site are
the trademarks, service, marks, or logos of their respective owners. By
using this web site, you acknknowledge the validity and enforecability
of the Ferrans Enterprise trademarks and agree that you will not in
anyway infringe, either edirectly or indirectly the trademarks.
All
materials on the Site, including without limitation text, images,
software, audio and video clips, and databases (collectively,
the "Content")
are owned, controlled, or used with permission by Simply Christian®,
which retains all right, title, and interest in and to the Content.
The Website and
Content are protected by the copyright and trademark laws of the
United States and other countries, international conventions, and
other applicable
laws.

Permitted noncommercial uses.
Teachers and parents are permitted to print individual Print-n-Play
and those Featured Weekly interactive activities which
lend themselves to printing for use by their students or children
only. Activities
are not to be collected, archived, or kept for the purpose of distributing
at a later date. Activities are not to be distributed as
part of any other non Online Sunday School™ material. It
is the intent that these materials are used online and privately
in the home or
church of the individual using the Online Sunday School™ (OSS). As
a user of the OSS web site you agree not to copy or
distribute the graphics, audio, or video clips of the website.

This software was formed/designed by combining both original
material and in part from pre-existing material. All pre-existing
material has been used, changed, or updated with permission and in
accordance with those individual copyrights. The pre-existing copyrights
appear
as part of this Site (software)
where appropiate. A summary of the pre-existing material and the associated
copyrights, which apply to Simply Christian's web site and not you
the user are shown below:
The Bible Reading/scripture was obtained from one of the following
sources:(1) The Holy Bible, New International Version. Copyright 1973,
1978, 1984. The NIV text may be quoted in any form, up to and inclusive
of five hundred verses without express written permission
of the publisher, providing the verses quoted do not amount to a
complete book. Or (2)
The Bible Reading/scripture is from the NIV version.

CrosswordMaker's
license is shown in as comments in the crossword.cgi script program.
Web
Concentration, a perl script, was updated and changed based on the
GPL v2 license which impliies the
right to change/sell/copy the original.
Jakes
Coloring Book is a java applet obtain at the javaboutique.internet.com.
This applet
is a free online coloring applet.
Numerous
additional java applets obtained from www.ericharshbarger.org. The
compiled applets are free for use
personal or commercial
webpages.
Numerous
interactive games are purchased from Clevermedia's Homepage Arcade.

The
jigsaw puzzle was purchased at http://www.ica-d.com/. A non-transferable
and non-exclusive
license granted to Simply Christian. Online
Quizzes created via 'Nice-n-Easy Quiz' which was updated. Orginal
'Nice-n-Easy Quiz' program was purchased
in 2002 from
http://www.62nds.co.nz with permission to make changes.
Graphics:
A combination of original creations, donated artwork from individuals,
and various clip art and artwork providers.
Web
site users
have no rights to copy or reuse the graphics on this site. The OSS
is
meant
to be
viewed
online via one's computer,
it is not a means to distribute lessons, ciriculum, graphic,
audio,
video, etc..
5.
Prohibited uses. Any use beyond the permission granted above, including
but not limited
to the
download, display, reproduce, create derivative works from, transmit,
sell, distribute,
or in any way exploit the Site or any portion thereof for any public
or commercial use without the prior written permission of Simply Christian®.
The Content may not be copied, modified, sublicensed, loaned, redistributed
or republished, in whole or in part, for public or commercial purposes
without the express written consent of Simply Christian®.
In
addition, you may not use the trademarks:
(a) in, as, or as part of, your own trademarks or those of any third parties;
(b) to identify products or services that are not those of Simply Christian®;
(c) in a manner likely to cause confusion; or
(d) in a manner that implies that Simply Christian® sponsors or endorses
or is otherwise connected with, your own activities, products and services

6. Permission requests.
Permission
request for use of the Simply Christian® or Online Sunday School™ trademarks
that exceed the above guidelines should be directed to, and approved
in writing by Simply Christian, P.O. Box 2175, Cranberry
Township PA, 16066.
7.
Modification of Agreement.
Simply Christian® reserves the right, at its sole discretion,
to change, modify, add or remove any portion of this Agreement, in whole
or
in part, at any time. Notification of changes in the Agreement
will normally be posted on the Web Site.
8.
Indemnification.
You hereby agree to indemnify, defend and
hold harmless Simply Christian® and
its Affiliates from and against any and all liability and costs incurred by
Simply Christian® or the Affiliates in connection with any claim arising out
of any breach or alleged breach of any of your obligations set forth herein
You shall cooperate as fully as reasonably required in the defense of any claim.
Simply Christian® reserves the right, at its own expense, to assume the
exclusive defense and control of any matter otherwise subject to indemnification
by you
and you shall not in any event settle any matter without the written consent
of Simply Christian®.
9.
Miscellaneous:
(a) Bible
Readings - At the present time, Simply Christian®
uses The
New International Version of The Holy Bible. NIV® is
a registered trademark of the InternationBible Society
(IBS).
Simply Christian® will
make a reasonable effort to provide a single weekly Bible
Reading for all grades, which is based on the Revised Lectionary
recommended by the United Methodist Board of Governor's.
(b) Service/Maintenance -
Simply Christian® reserves the right to atler, change, or suspend
the Online Sunday School™
web site unexpectedly without warning.
(c) Links
to Other Sites - Although Simply Christian® works hard
to limit the number of links to external sites available as part
of the Site, the Site may contain links and pointers to other sites
on the Internet which may be maintained by third parties. Such
links do not constitute an endorsement by Simply Christian® or
its Affiliates of any third-party site or any materials contained
therein. Simply Christian® and its Affiliates do not control,
and are not responsible for, the availability, accuracy, privacy
policy, or currency of such third-party sites or any information,
content, products
or services accessible from such third-party sites.
(d) Providng
Content/Communication with the Site or Simply Christian -
With the
exception
of
a
user's
account
set-up
information,
which
shall
be
deemed
confidential between its User (see our privacy policy), Simply Christian® and
the participating vendors selected by the User, any information or material
sent to Simply Christian® for the purposed of being published on the
Online Sunday School™ web site will be treated as non-confidential
and non-proprietary and may be used by Simply Christian® for any purpose.
The information is transmitted at the sole risk of the User and Simply
Christian® will
assume no liability for interception of the information.
The
User agrees that any information, material, or content sent to Simply Christian® is
the property of Simply Christian®.
(e) Privacy
Policy - The terms and conditions of
Simply Christian's privacy
policy
are set out in the section labeled "Privacy" on
the Home Page of the site and (as they may be changed by Simply
Christian® in its discretion) are incorporated herein and included
in this agreement.
(f) General -
This Agreement constitutes the entire agreement between you the user
of the website and Simply
Christian® with
respect to the Site and, if applicable, the Services and supersedes
all prior agreements between you and Simply
Christian®.
United Methodist Conferences participating as Conference Partners
may have an additional and separate Service Agreement.
Failure
by Simply Christian® to
enforce any provision of this agreement shall not be
construed
as
a waiver
of
any provision
or
right. Interpretation
and enforcement of this agreement shall be governed by the laws
of the state of Pennsylvania (excluding its choice of law rules).
In
any such action, the prevailing party shall be entitled to recover
all legal expenses incurred in connection with the action, including
but not limited to its costs, both taxable and non-taxable, and
reasonable attorney's fees. In the event that any portion of this
Agreement
is held unenforceable the unenforceable portion shall be construed
in accordance with applicable law as nearly as possible to reflect
the original intentions of the parties, and the remainder of the
provisions shall remain in full force and effect.
11.
DISCLAIMER OF WARRANTY.
EXCEPT AS EXPRESSLY SET FORTH HEREIN, THE SITE (INCLUDING ALL CONTENT, SOFTWARE
FUNCTIONS, SERVICES, MATERIALS AND INFORMATION MADE AVAILABLE THEREON OR ACCESSED
BY MEANS THEREOF) ARE PROVIDED AS IS, WITHOUT WARRANTIES OF ANY KIND, EITHER
EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF TITLE OR IMPLIED
WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, COMPATABILITY,
SECURITY, ACCURACY, OR NON-INFRINGEMENT. TO THE FULLEST EXTENT PERMISSIBLE
BY LAW, Simply Christian AND THE AFFILIATES MAKE NO WARRANTIES AND SHALL NOT
BE LIABLE FOR THE USE OF THE SITE UNDER ANY CIRCUMSTANCES, INCLUDING
BUT NOT LIMITED TO NEGLIGENCE BY Simply Christian. Simply Christian DOES NO
WARRANT THAT THE FUNCTIONS CONTAINED IN THE SITE OR THE SERVICES WILL BE UNINTERRUPTED
OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, THAT THE SITE OR SERVICES WILL
MEET ANY PARTICULAR CRITERIA
OF PERFORMANCE OR QUALITY, OR THAT THE SITE, INCLUDING FORUMS OR THE SERVER(S)
ON WHICH THE SITE IS OPERATED, ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

LIMITATION OF LIABILITY.
USE OF THE SITE IS AT YOUR OWN RISK. YOU ASSUME FULL RESPONSIBILITY AND RISK
OF LOSS RESULTING FROM YOUR DOWNLOADING AND/OR USE OF FILES, INFORMATION, COMMUNICATIONS,
CONTENT, OR OTHER MATERIAL (INCLUDING WITHOUT LIMITATION SOFTWARE) ACCESSED
THROUGH OR OBTAINED BY MEANS OF THE SITE. UNDER NO CIRCUMSTANCES SHALL Simply
Christian OR THE AFFILIATES, OR ANY PROVIDER OF TELECOMMUNICATIONS OR NETWORK
SERVICES FOR Simply Christian OR THE AFFILIATES, BE LIABLE FOR ANY INDIRECT,
PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES THAT ARE DIRECTLY OR INDIRECTLY
RELATED TO THE USE OF, OR THE INABILITY TO USE, THE SITE OR SERVICES, EVEN
IF Simply Christian, THE AFFILIATES, OR THEIR PROVIDERS OF TELECOMMUNICATIONS
OR NETWORK SERVICES HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE
TOTAL LIABILITY OF Simply Christian AND THE AFFILIATES HEREUNDER IS LIMITED
TO THE AMOUNT, IF ANY, ACTUALLY PAID BY YOU FOR ACCESS AND USE OF THE SERVICES.
YOU HEREBY RELEASE Simply Christian AND THE AFFILIATES FROM ANY AND ALL OBLIGATIONS
LIABILITIES AND CLAIMS IN EXCESS OF THIS LIMITATION. SOME STATES DO NOT ALLOW
THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE
ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.
12.
Termination.
In addition to any other rights of the parties set forth herein, Simply Christian® may
cancel or terminate this Agreement at any time. Simply Christian® also
reserves the right to restrict, suspend or terminate your access to the Services
i whole
or in part, without notice, with respect to any breach or threatened breach
by you of any portion of this Agreement. If Simply Christian terminates this
Agreement based on a breach of any portion of this Agreement, Simply Christian
reserves the right to refuse to provide a subscription or any Services to you
in the future.
Using
to Simply Christian’s Online Sunday School™ indicates your agreement
to the terms and conditions set forth above.
